Pann: EXO's plagiarism controversy put to rest
VM Production, the production company behind EXO's teaser video, told OSEN, "It is not plagiarism because we paid the graphic designer for permission for use. We are surprised at this situation and have contacted the graphic designer for further action."
SM rep also said, "EXO's comeback teaser was produced professionally by a production company for the 'MAMA' ceremony on December 3rd. We have asked VM Production for to take quick action and will work hard towards making sure that EXO's comeback teaser is back up in service."

I think some possibilities could be, that one graphic designer plagiarized another, in this case the one VM production paid plagiarized someone else who is now complaining.
Or
Its the same graphic designer but because VM was the middle man they did not know their designs were being sold to SM and when they came across EXO's stuff and saw their work they got upset thinking it had been copied. Which might mean this is a big misunderstanding and there was poor communication down the line if they were not informed exactly what their designs were being used for.
I don't want to come off as protecting SM but give them some respect.

ReplyDeleteI don't think there is enough room (even by my standard of ridiculously long comments) to understand SM as a company =/.
Its so huge, has contracts, agreements to pay other companies to do work or buy rights that there might be times when the left hand doesn't know what the right hand is doing and neither might be doing what the head wanted them to do in the first place.
Just thoughts trying to understand the company:
SM works with middlemen (contractors). The advantage of contractors is you have more flexibility in your options and can negotiate more easily for a better price. As they have so many groups and people to manage its probably faster and cheaper for them to hire outside people for designs and ideas that are already created rather than maintain people within the company to do it, taking time creating and costing the company money in resources in the meantime. Buying rights to images, music etc. can be done directly and indirectly. Different people you deal with may go about supplying you in different ways, but SM ends up paying for what they want probably on the faith that its legally produced.
However its also cheaper to take things if you can get away with it. Its cheaper to make copies of very expensive outfits than buy the original and if its different enough or you are low profile enough on the global market or if you're too much trouble to chase up on a lawsuit or the offense is too petty you can save pennies.
(Many business people will happily cut corners if it increases their profit margins).

ReplyDeleteTo clarify what happened. It's not the question about plagiarism. That was the phrase used by Soompi. It was a question of copyright infringement.
ReplyDeleteVM Production had used copyright protected material from me and others when making the video. So, they made the mistake, not SM.
The only misstake made by SM was to not answer our first notice of copyright infringement done already in december. The only way to get an reaction was then to go via youtube and report the copyright issue there.
I believe SM was sure that VM had the all the copyright right permissions under control, but they clearly missed that part for me and a couple of other designers.
VM have now properly payed a licens for using the material in the video and terms have been agreed, by that it is no longer blocked on YouTube.

lol, but it's not really a bad thing that the guy may have been given money to settle it. That's how these situations usually end up to begin with. There are plenty other things that make SM sketchy, but paying an artist for using their work or to settle an agreement is not one of those things.

5. [+54, -1] I was really proud at how quiet EXO-L stayed during all of this. I feel like we've finally learned how to deal with scandals ㅠㅠ And I'm glad that it's not plagiarism, I hope it's all figured out soon.

To be honest, EXO-L's silence during this ~scandal~ doesn't prove anything for me--I want to see how maturely they can handle their fave's problematic statements or dating rumors the next time a real issue crops up. It's nothing for them not to shield this since it was an issue of design team management to begin with. A true test of their maturity will come from a scandal involving an actual member of EXO; until then, miss me with the self-congratulatory "crediting ourselves for not reacting childishly for once" parade.
what the.... when no one hires graphic designers, where will they get their money from? Why should they work? Why should they create something like that.

ReplyDeleteSoderberg had a reason to speak out, and when he did VM claimed they paid him for use. It's completely possible that VM paid him only after his story got attention bc otherwise he wouldn't have spoken out before and he wouldn't be saying everything is ok now lol
